Terms of Service
The rules for using The Token Maker, including your content, the borders you can use, and our responsibilities.
These terms are an agreement between you and The Token Maker ("we", "us") for using thetokenmaker.com (the "Service"). By using the Service you agree to them. If you don't agree, don't use the Service.
The Token Maker is an independent fan tool. It is not affiliated with, endorsed by, or sponsored by Wizards of the Coast, Roll20, Foundry Gaming or Owlbear Rodeo. Dungeons & Dragons and D&D are trademarks of Wizards of the Coast; Roll20, Foundry Virtual Tabletop and Owlbear Rodeo are trademarks of their owners. We mention them only to say what the tokens work with.
1. Using The Token Maker
The Service is free and needs no account. It runs in your browser: the images you add are processed on your device and are not sent to us.
2. Your content
Your images. You keep all rights in the images you add. Only use images you own or have permission to use. You are responsible for the images you put into tokens and for how you use the tokens you make.
Your tokens. As between you and us, the tokens you download are yours to use, subject to the rights in the images inside them and the border terms below.
The borders. The border designs are generated by the Service. You may use tokens and frames with our borders in your own games, streams, videos and free handouts. Selling products that contain our borders (for example token packs, adventures or VTT modules) needs a commercial license, which will be offered separately. You may not resell or redistribute the border designs on their own as a border pack or asset collection, or use them to build a competing token tool.
3. What you can't do
Don't use the Service to make content that is illegal, that sexualizes minors, or that infringes someone else's copyright, trademark or other rights. Don't try to disrupt the Service or access it in ways it isn't meant to be accessed.
4. Changes to the Service and these terms
We may change, suspend or stop any part of the Service. We may update these terms; continuing to use the Service after a change means you accept the updated terms. When accounts and paid plans launch, these terms will be updated first.
5. Disclaimers
The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, including that the Service will be uninterrupted or error-free, or that results will meet your needs.
6. Limitation of liability
To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim relating to the Service is limited to US$50. Some places don't allow these limits, so they may not apply to you.
7. Indemnity
You agree to cover our reasonable costs from claims caused by content you put into tokens, or by your breach of these terms.
8. Governing law
These terms are governed by applicable law. Disputes may be submitted to a court or arbitration body with jurisdiction, unless the law where you live gives you the right to bring claims locally.
